NMPRC issues order to show cause in PNM acquisition case

NMPRC issues order to show cause in PNM acquisition case

Commission seeks clarification on a 2025 stock transfer; no final decision

SANTA FE – The Hearing Examiners for the New Mexico Public Regulation Commission (NMPRC) have directed the Joint Applicants in the proposed acquisition of Public Service Company of New Mexico (PNM) to explain a significant stock purchase completed last year.

According to filings in the case, an affiliate of Blackstone Infrastructure purchased eight million shares of TXNM Energy, Inc. – PNM’s parent company – for $400 million in June 2025. Some parties argue that this deal should have been submitted to the Commission for review and approval, but the Joint Applicants say that prior authorization wasn’t required.

After reviewing the filings, the Hearing Examiners determined that additional information is necessary and issued an Order to Show Cause. The order requires the Joint Applicants to explain how the stock purchase complies with New Mexico statutes governing utility acquisition cases.

The Joint Applicants must file their response by April 6. Other parties in the case may also file comments on that date, with responses due by April 20.

Separately, the Hearing Examiners scheduled a status conference with the parties in the case for March 16 to discuss upcoming procedural deadlines. The status conference will give the parties an opportunity to discuss the current procedural schedule in light of the order to show cause.

The order does not find a violation of any rules, nor a determination regarding the validity of the stock purchase or the proposed acquisition. The Commission will continue reviewing all information before making any final decisions.

New Mexico's first Community Solar Project is online. The Cuidando Los Niños community solar project includes more than 14,000 solar panels and will produce 5MW, enough to offset the energy usage of 2,000 homes. REIA-NM Board President and Director of Commercial Solar Development at Affordable Solar, Dylan Connelly, had this to say about the historic event:

“We can have low cost, clean energy available for every household in New Mexico, regardless of their income, it’s no longer a rich person’s game. Santa Fe County Commissioners Have Approved the Rancho Viejo Solar Project

After months of opposition, public hearings, and hours of testimony, the commissioners voted 4-1 on Tuesday to approve the controversial project.

According to Joshua Mayer, senior development manager for The AES Corporation, a REIA-NM member and the developer behind Rancho Viejo, this is “an essential step toward delivering safe, reliable, and affordable energy to the local grid as energy demand continues to rise, while directly advancing New Mexico’s clean energy goals.”

Announcing the New Mexico Climate Investment Center's Small Loan Program

The New Mexico Climate Investment Center (NMCIC) is excited to announce the launch of a Small Loan Program for small businesses and nonprofits serving New Mexico. The program will provide affordable financing in the form of individual loans of up to $250,000 to help fund energy efficiency, clean energy, electrification, and other emissions-reducing projects.

NMCIC is New Mexico’s first “green bank”, an investment fund created to accelerate the state’s transition to clean energy and climate resilience. Its mission is to reduce energy burdens and greenhouse gas emissions while fostering economic prosperity and equity for communities across New Mexico. In addition to the Small Loan Program, NMCIC offers bridge financing, permanent, construction, and C-PACE loans for projects that reduce GHG emissions, increase energy or water efficiency, lower energy costs, and bring benefits to low-income and disadvantaged communities.

LG Energy Solution, a division of the major Korean battery manufacturer, is now producing battery cells for grid-scale energy storage at a site in Holland, Michigan.

The company spent $1.4 billion to expand the factory, and the investment onshores production of a popular battery chemistry that had been almost exclusively made in China, amid tariff and tax policy uncertainty.

SEIA's Solar Market Insight Report for Q1 of 2025

This week, SEIA and Wood Mackenzie released the Solar Market Insight Report for Q1 of 2025.

The report finds that solar added 10.8 GW of new electricity generating capacity and 8.6 GW of new solar module manufacturing capacity in Q1. Solar and storage accounted for 82% of all new generating capacity added to the grid and communities added 8 new or expanded factories in Texas, Ohio, Arizona, and South Carolina while American solar cell production capacity doubled.

According to SEIA president and CEO Abigail Ross Hopper, “Solar and storage continue to dominate America’s energy economy, adding more new capacity to the grid than any technology using increasingly American-made equipment... But our success is at risk. If Congress fails to fix the legislation passed by the House – which would render the energy tax incentives unusable – lawmakers will trigger a dangerous energy shortage that will raise our electric bills and stop America’s manufacturing boom in its tracks."

New Energy Efficiency Revolving Loan Fund to be managed by EMNRD

New Mexico is stepping up its commitment to energy efficiency! The state's Energy Minerals and Natural Resources Division has secured $5.3 million from the U.S. Department of Energy to establish an Energy Efficiency Revolving Loan Fund.

This fund offers low-interest loans (2% fixed rate, $250,000-$1 million) for crucial energy efficiency upgrades like smart thermostats, HVAC, insulation, and lighting. Solar and electric panel upgrades are also eligible as part of comprehensive projects. The program targets private nonprofit and for-profit entities with buildings benefiting the public, such as healthcare and educational facilities.

This initiative will help reduce utility bills, decrease building emissions, boost New Mexico's economy, and protect our environment. It's a significant step towards a sustainable future for our state!

Albuquerque Mayor Announces Executive Order to Speed the Transition to Renewables at Electrify New Mexcio

Albuquerque Mayor Tim Keller is pushing back against President Donald Trump’s latest executive order on coal production.

During the Electrify New Mexico conference Friday morning, the mayor signed his own executive order to speed up the transition away from fossil fuels at city buildings.

That includes fully converting to renewable energy for all city operations by the end of the year.

Governor appoints former GOP state senator to PRC

Gov. Michelle Lujan Grisham has appointed a former Republican state senator and oil and gas lawyer to a six-year term on the New Mexico Public Regulation Commission.

Greg Nibert of Roswell beat out five other final candidates for the role, including outgoing commissioner James Ellison, who was vying for another term after being appointed by Lujan Grisham in January 2023 to a two-year term. Read more here.

UNM's SPSP Internship Program is now Open

REIA OpEd in response to ABQ Journal series on predatory sales practices in the solar industry.

On August 16, the Albuquerque Journal published an Op-ed authored by our executive director, Jim DesJardins, in response to several articles about predatory sales practices in the solar industry. REIA is taking this issue very seriously.

We Condemn Predatory Practices in Our Industry

As the executive director of The Renewable Energy Industries Association of New Mexico (REIA-NM), a trade association which represents more than 60 members in the solar industry, I was disheartened to read the Albuquerque Journal articles about predatory solar sales practices occurring in New Mexico and yet grateful that these issues are coming to light. It is unfortunate that practices by a handful of companies threatens to harm the integrity of a thriving industry in New Mexico.

As more than 40,000 New Mexicans know, the benefits of installing solar on your home and business are numerous including lower electric bills and reducing reliance on fossil fuels. The solar industry also benefits our state by positively contributing to the economy, employing more than 2,000 New Mexicans, paying local and state taxes, purchasing supplies from local companies and investing more than $433 million in the state just in 2022.

REIA-NM has been aware of this consumer issue in the industry for some time and was actively involved with others in the passage of the Distributed Generation Consumer Protection bill in the 2017 New Mexico legislative session. This law requires reasonable and appropriate disclosures by solar companies to solar customers in New Mexico

REIA-NM has continued to work on this issue (before the publication of these articles) by meeting with the New Mexico Attorney General's office, the New Mexico Energy, Minerals & Natural Resources Dept, state legislators, municipalities and utilities to address these issues that are bad for our industry and the general public. We have also recently updated our website with a tab for "Consumer Information" that we will build out with additional information.

Unfortunately, a few companies are still taking advantage of customers to make a quick buck. REIA-NM is committed to work with other stakeholders to root out these bad actors in our industry so that "solar" has a good name in our communities.

A few suggestions for New Mexicans who may be considering adding solar energy to their home or business include:

· Always get bids from at least two solar companies.
· Make sure that you understand whether you will own, lease or have a power purchased agreement and all costs associated with financing the system.
· Quotes should include all costs, including any required upgrades and specific warranty information.
· A quote should separately itemize all tax credits. The New Mexico solar tax credit has a limited amount of funds and the federal tax credit requires tax liability.
· Ask who will be installing the system.
· The New Mexico Distributed Generation Disclosure form should be provided when an agreement is signed or such language should be imbedded in the contract.

Energy Storage & Reliability for our Renewable Future

October 23-24, 2023. | Santa Fe, New Mexico

Visit the southwest this fall to participate in a two-day energy storage workshop hosted by the New Mexico Renewable Energy Transmission Authority. This workshop focuses on a critical component of transitioning to a renewable energy future – energy storage to meet capacity and reliability challenges.

The event will be held at the historic La Fonda Hotel in downtown Santa Fe, October 23-24, and will include speakers from the private and public sector discussing utility energy storage technologies, finances, and policies. There is no cost to attend, other than your travel and lodging. The agenda is currently being developed and will be made available in July. Information on the workshop will be posted to the RETA website and distributed by email.

House Bill 32, calling for an Energy Storage Tax Credit in New Mexico, is one of REIA’s priorities for the 2023 legislative session. We are at a critical time for tackling climate change and transitioning to a clean energy economy. Energy storage benefits are numerous including providing backup power when there is a power outage, saving utilities and customers money by reducing the need for new infrastructure, and providing the potential to balance energy supply and demand.

Administration Announces $56 Million to Advance U.S. Solar Manufacturing and Lower Energy Costs

New Investments Will Build on Bipartisan Infrastructure Law Funding to Bolster Clean Energy Supply Chains, Increase Energy Security, and Lower Electricity Bills

WASHINGTON, D.C. ― The Biden-Harris Administration, through the U.S. Department of Energy (DOE) today announced a slate of new initiatives and $56 million in new funding, including $10 million from President Biden’s Bipartisan Infrastructure Law, to spur innovation in solar manufacturing and recycling. Together, the funding will help make clean energy more affordable and reliable, create good-paying jobs, and enhance U.S. economic growth and competitiveness. Developing more solar power, the cheapest form of new electricity supply, is key to achieving President Biden’s goal of 100% clean electricity by 2035.

“This administration wants to seize U.S. leadership in solar energy, from manufacturing to recycling, and that means making the right investments to ensure these technologies are made right here at home,” said U.S. Secretary of Energy Jennifer M. Granholm. “Thanks to President Biden’s Bipartisan Infrastructure Law, DOE is able to invest in our nation’s innovators so they can improve manufacturing and strengthen the domestic solar supply chain—lowering energy bills for Americans and businesses and driving toward an equitable clean energy future.”

According to DOE’s Solar Supply Chain Review Report, developing more domestic solar manufacturing can lead to benefits to the climate and environment as well as for American workers, employers, national security, while lowering energy bills for American families. The new programs announced today are designed to drive innovation in solar technology and manufacturing, supporting opportunities for the U.S. to expand production of thin-film modules, which do not rely on foreign-dominated supply chains, as well as supporting newer technologies like perovskite solar cells.

DOE’s New Solar Innovation Funding Opportunities

The $29 million FY22 Photovoltaics (PV) Research and Development funding opportunity includes $10 million from the Bipartisan Infrastructure Law to support projects that increase the reuse and recycling of solar technologies. The funding opportunity also supports projects to develop PV module designs that reduce manufacturing costs, as well as those that advance the manufacturing of PV cells made from perovskites, a family of materials that show potential for durability, high performance, and low production costs.

The FY22 Solar Manufacturing Incubator funding opportunity will provide $27 million for projects aimed at commercializing new technologies that can expand private investment in U.S. solar manufacturing. Funding is available for projects that ready new technologies and manufacturing processes for commercialization and demonstrate solutions that can boost domestic manufacturing of thin-film PV made from cadmium telluride, the second-most common PV technology on the market, behind silicon.

DOE’s Continued Commitment to Solar Energy

Today, DOE also announced $18 million in funding through the Technology Commercialization Fund for seven proposed National Laboratory projects designed to tackle commercialization challenges DOE-funded technologies face on their path to market.

DOE is also issuing a Request for Information on challenges and opportunities for vehicle-integrated PV, which would enable solar energy to provide power to vehicles, including cars, recreational vehicles, trains, boats, and planes. The solar and transportation industries and other stakeholders are encouraged to submit feedback by August 22 at 5 p.m. ET.

Earlier this week, DOE announced $8 million will go to seven small solar companies to perform research and development in concentrating solar-thermal power, power electronics, and solar-powered water technologies.
